Army Sgt. Darren Manzella is breaking the military policy of “don’t ask don’t tell”.
Manzella has stated “It has never affected my job performance before. I don't think it will make a difference now. And to be honest since then, I don't see a difference because of my homosexuality."- http://news.yahoo.com/s/ap/20080109/ap_on_go_ca_st_pe/

Manzella says that he doesn’t see a difference of being a homosexual, but then he goes out of his way to bring up the fact that he is a homosexual. If being a homosexual does not affect his job, then why bring it up?
Further, it is not Manzella that the policy was created for; it is the other non-homosexual soldiers surrounding him that have the issue. “Don’t ask don’t tell” wasn’t for the protection of homosexuals, it was to eliminate distraction to non-homosexuals that would serve along side of homosexuals. This is not about homosexuality. It is about insubordination.
